Services are offered by quotation. No service is purchased or paid for directly on arcomcanada.com. Last updated: October 22, 2026.
1. Provider and purpose
These terms govern services provided by L’Entité Nexus inc., under the trade name ARCOM Canada, to a client who accepts them. They supplement the written proposal given to the client, which takes precedence in case of inconsistency to the extent permitted by applicable law.
The website does not allow online purchases or payments. Viewing it or sending a message is not an order, reservation or obligation to intervene.
2. Services and exclusions
Services concern crisis management, risk analysis and crisis communication: analysis, preparation, training, decision support and coordination under the accepted engagement.
The services presented do not include private investigation, locating individuals, tailing or surveillance. They do not include legal advice, immigration advice or regulated professional representation. A need of this nature is referred to an authorized provider or qualified professional with whom the client contracts directly. ARCOM Canada is not a party to that separate contract and does not receive its price.
Services may also include training, simulations and debriefs. The audience, objectives, format, arrangements, any prerequisites and learning deliverables are set out in the written proposal. The catalogue does not promise certification.
3. Initial discussion and contract formation
The initial consultation is free and without obligation. If assistance is possible, a written proposal specifies the scope, deliverables, estimated timeframe, fees and payment arrangements.
The contract is formed by written acceptance of the proposal, for which email is sufficient, and payment of a deposit where required. Sending a message alone does not create an accepted engagement.
4. Fees, taxes and payment
Unless the proposal states otherwise, fees are in Canadian dollars, with GST and QST added. Services are subject to a written proposal.
Unless different terms are agreed in writing, a 50% deposit is payable upon acceptance of the proposal and the balance is due when the report or deliverable is provided. Payment is arranged directly by Interac e-Transfer, cheque or cash with a receipt. An invoice is issued for each payment.
No payment is requested or accepted through the website. Late payment of the balance may suspend release of the deliverable under the agreement and applicable rules. These terms do not create any interest or late fee that has not been agreed.
5. Client obligations and scope
The client provides accurate information, materials needed for the engagement and details of people authorized to make decisions. The client submits only materials legitimately held and authorized for disclosure.
Material obtained through unauthorized account access, interception of communications, unlawful geolocation or another illegal method is refused and its deletion is handled subject to any contrary legal obligation. Such a breach may lead to termination under the agreement and applicable law.
Additional requests or a material change in circumstances may require a written adjustment to the scope, schedule or fees before work proceeds.
6. Deliverables and timing
Deliverables and the delivery channel are defined in the proposal. Encryption and transfer arrangements appropriate to the matter are agreed before sensitive information is sent.
Estimated timeframes depend in particular on the client supplying materials, their quality and the circumstances of the engagement. Analysis relies on authorized, available material; its completeness or authenticity is not guaranteed merely because it has been supplied.
7. Cancellation, postponement and termination
The client may cancel before work begins. The deposit is then refunded after deduction of authorized expenses incurred. After work begins, services performed remain payable proportionately, subject to specific terms and applicable rules.
A request to postpone, change or end an engagement must be made in writing. The provider may terminate if the client breaches their obligations or the request concerns an excluded activity, under the terms of the agreement.
Consumer clients retain the mandatory rights provided by the Consumer Protection Act, including for distance contracts. Nothing in these terms restricts those rights.
8. Confidentiality and personal information
A confidentiality undertaking is signed before each engagement. Matters are handled separately, with access, encryption and disclosure arrangements organized according to the matter’s needs.
The client’s identity and engagement materials are not used as a public reference without their agreement. Personal information is handled under the Privacy policy and applicable rules.
Do not send sensitive files in an initial email. Nothing on this website creates regulated professional secrecy or legal privilege; obligations specific to the relevant participants continue to apply.
9. Responsibilities
Services are subject to an obligation of means under the commitments agreed. Analysis and recommendations support the client’s decisions; those decisions remain the client’s within the responsibilities defined by the agreement.
The website and recommendations do not guarantee a media, commercial, legal or reputational outcome. Responsibilities remain governed by the agreement and applicable law. Nothing in these terms excludes liability that cannot lawfully be limited.
10. Ownership and use of deliverables
Pre-existing methods, tools and templates remain the property of the provider or their owners. The client receives the usage rights necessary for the engagement’s purpose under the accepted proposal.
Reports are supplied for the client’s needs defined in the engagement. Broader publication, reproduction, transfer or exploitation rights, along with third-party rights, are set out in the agreement.
11. Emergencies and external events
Services are not a public emergency service. If there is immediate danger in Canada, call 911. Viewing the website does not imply any intervention timeframe or permanent availability.
The effects of an event reasonably beyond the parties’ control, an interruption or inability to perform are handled under the agreement and applicable law.
12. Applicable law and contact
Services are governed by applicable Québec and Canadian law. Disputes fall within the competent courts of the judicial district of Montréal, subject to mandatory rules, including those protecting consumers. The parties are encouraged to seek an amicable solution first.
